ORDER

[Order of the Court was made by M.M.SUNDRESH,J.] This contempt petition has been filed seeking to punish the respondents for having willfully and deliberately disobeyed the order of this court dated 18.01.2018 made in W.A.No.1661 of 2017.

2. The following are the instructions given from the Office of the Director of Survey and Settlement to the Special Government Pleader, High Court of Madras vide R.C.M2/9867/2016 (Survey) dated 10.03.2020:- "(2) In this regard, I am to state that in order to comply the orders of the Hon'ble High Court dated 18.01.2018 in W.A.No.1661 of 2017, the Government has issued orders in G.O.(1D) 266, Revenue and Disaster Management Department dated 16.07.2019 (copy enclosed) regularizing the services of Thiru.T.A.Joseph in the category of Field Survyor with effect from 13.02.1998.

(3) The Assistant Director of Survey, Coimbatore, has issued orders regularizing the services of the petitioner in t his proceedings No.Ka.Ka.A8/505/2017 dated 19.07.2019 in the 2 / 4

category of Field Surveyor with effect from 13.02.1998 and also issued orders declaring the probation of the petitioner as on 12.08.2000, in Na.Ka.A8/505/2017 dated 22.07.2019.

(4) The Assistant Director of Survey, Coimbatore, in his proceedings Na.Ka.A1/4988/2019

(1) dated 14.02.2020 has issued orders including the name of the petitioner in the panel of Firka Surveyor for the year 2009.

(5) The Assistant Director of Survey,Coimbatore, in his procedings Na.Ka.A1/4988/2019(2) dated 14.02.2020 has issued orders regularising his services in the category of Firka Surveyor.

(6) The Assistant Director of Survey, Coimbatore, in his proceedings Na.Ka.E/5004/2019 dated 14.02.2020 has issued orders fixing his pay and ordering increments in the category of Firka Surveyor with effect from 01.06.2009.

(7) The Assistant Director of Survey and Land Records, Coiombatore, who is the appointing authority, has requested the petitioner in his memo dated 03.02.2020 to submit the pension application form in order to forward his pension proposals to the Accountant General and it is awaited from the petitioner. After receipt of the same, his pension proposal shall be sent to the Accountant General." 3 / 4

3. In view of the above, contempt petition stands closed. However, if the petitioner has not submitted his pension application so far, the same will have to be submitted within a period of four weeks from the date of receipt of a copy of this order and on receipt of such application for pension, the same will have to be forwarded to the Accountant General within a period of six weeks thereafter. We further make it clear that if the petitioner has already submitted the pension application, the same will have to be forwarded to Accountant General within a period of six weeks from the date of receipt of a copy of this order.
