ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.02.2026 for the alleged offences under Sections 108 of the Bharatiya Nyaya Sanhita, 2023, ( under Section 306 of Indian Penal Code, 1860 ) in Crime No.32 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant's daughter, namely Kaviya, was married to the petitioner' s son on 16.09.2024 and they were living together. It is alleged that on 04.02.2026, the petitioner and other family members scolded and threatened the deceased. Thereafter, the deceased went to her parental house, informed about the incident and also posted a message in social media stating that she intended to commit suicide due to harassment by her in-laws. Subsequently, the deceased along with her minor female child committed suicide by jumping into a well. Hence, the case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is aged about 55 years and he is no way connected with the alleged suicide committed by the deceased. It is submitted that the marriage between the petitioner' s son and the deceased was conducted with the consent of both families. The learned counsel would further contend that the petitioner has been falsely implicated in this case. Hence, he prayed for granting bail.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the deceased along with her seven year old female child committed suicide only due to the continuous harassment by the petitioner and his son. It is further submitted that the allegation is serious in nature involving abetment of suicide of both the deceased and a minor child. The

learned Government Advocate (Crl.Side) would submit that the RDO enquiry is still in progress and if the petitioner is enlarged on bail at this stage, there is every likelihood of tampering with witnesses and affecting the investigation. Hence, he strongly opposed the grant of bail.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

This Court is of the view that from the submission of the learned counsel on either side, it is seen that the allegation against the petitioner is that due to the harassment caused by the petitioner and his son, the deceased along with her minor child committed suicide. It is also seen that the RDO enquiry is still in progress and the investigation has not been completed. Further, taking into account the submission of the learned Government Advocate that there is a likelihood of tampering with witnesses if the petitioner is enlarged on bail, this Court is of the view that this is not a fit case to grant bail at this stage. Hence, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 18-03-2026 NSL
