This application has been filed by Mr. M.Ravichandran seeking to implead himself as a defendant in the suit.

2. The suit has been laid by the plaintiff for partition and separate possession in respect of the estate of late M.V.G.K. Appa Rao and for consequential reliefs. The plaint proceeds on the footing that late M.V.G.K. Appa Rao died unmarried on 21.02.2025 and that several documents, including settlement deeds, power of attorney and a purported Will, are not genuine and are liable to be declare null and void . The suit schedule properties and the challenge are thus directed against title and devolution of the estate of the deceased.

3. The applicant states that he entered into a binding agreement dated 11.12.2018 with late M.V.G.K. Appa Rao, the plaintiff and defendants 1 and 2 in relation to the very same property at Varadharajapuram Main Road, Chennai, under which he, as facilitator, undertook the task of clearing longstanding encroachments, and in consideration thereof he was to be allotted 2.5 flats in the project.

4. He stated that the pendency of the present suit has affected his ability to secure conveyance of the flats and monetary consideration. He therefore asserts that any order passed in the suit would directly affect his Page No.3 of 5

rights.

5. There is no serious objection raised on the side of respondents in allowing the application by impleading the applicant as defendant. 6.In view of the same, this A.No.1647 of 2026 is allowed.

7. The Registry is directed to carry out the necessary amendment in the cause title.
