Subadhra v. The Inspector Of Police
in Crl.O.P.No.6897 of 2022 Dr.JUSTICE G.JAYACHANDRAN.,J This Criminal Miscellaneous Petition has been filed by the petitioner/defacto complainant to cancel the anticipatory bail granted by this Court on 25.03.2022.
2. Reasons stated in the petition to cancel the bail is that the accused have suppressed the earlier criminal case against them and also the nature of injuries sustained by the defacto complainant. It is also contended by the learned counsel for the petitioner/defacto complainant that in the said incident, two other persons were also sustained injuries and that fact also suppressed. Medical Certificate with regard to the same also enclosed along with the typed set of papers.
3. This Court on perusal of the documents relied by the petitioner/defacto complainant found out that the earlier F.I.R was registered in Crime No.1133 of 2021 one year ago and the CD file does not indicate any injured person except the defacto complainant.

4. This Court finds that there is a case against the petitioner and their family members was registered by the police and pending investigation in Crime No.146 of 2017. The whole dispute between these two groups is in connection with the property which is the subject matter of First Appeal. As far as the anticipatory bail already granted, there is no report of breach of bail condition or any threat to the defacto complainant as alleged.
5. In view of the above, this Court does not find any reason to re-consider the anticipatory bail granted by this Court. Hence, this petition to cancel the anticipatory bail, is dismissed.
