Respondents PRAYER: Writ Petition came to be numbered by transfer of O.A.No.6173 of 2002 on the file of the Tamil Nadu Administrative Tribunal seeking to direct the respondent to draw the inter-se seniority list between direct recruits and promotees to the substantive posts in the category of Labour Officer as per quotarota rule prescribed in Rule 3(a) of T.N.Labour Service Special Rules and to promote the petitioner to the higher post according to his seniority with all attendant service and monetary benefits. ORDER

When the matter was taken up, Mr.M.Govindaraj, learned counsel appearing for the petitioner, fairly submitted that, in view of the judgment passed by this Court in W.A.No.458 of 2012, dated 06.06.2014, confirming the order passed in W.P.No.36829 of 2007, dated 21.09.2011, the prayer in the present writ petition has become infructuous. It is further submitted that the above said judgment passed in the writ appeal has not been implemented by the respondents as on today, therefore, he sought for liberty to move an appropriate application to enforce the above said order passed in the writ appeal.

Recording the above said submission of the learned counsel for the petitioner, the present writ petition stands dismissed as infructuous, with liberty to move an appropriate application before the appropriate forum to work out his remedy. No Costs.
