It is brought to our note that the sole respondent in A.S.No.313 of 2023 died even on 29.02.2020. However, the appeal itself has been filed against the dead person on 19th April 2022. Despite the fact that the factum of death was brought to the notice of the learned Special Government Pleader even on 05.08.2022 and time has been granted to the learned Special Government Pleader to take steps on 26.08.2022, no steps have been taken. However, it appears that the delay in filing the appeal was condoned on 06.04.2023 in the absence of the legal representatives, so the said order condoning the delay in filing appeal is suo motu recalled, since it is a nullity, as it has been passed against a dead person. The condone delay petition will stand dismissed as abated.
