C.M.P.Nos.8351 to 8353 of 2024 in A.S.No.465 of 2017 P.T.ASHA, J, These petitions have been filed by the petitioners/appellants to condone the delay of 563 days in filing the application to set aside the abatement caused due to the death of the deceased second respondent; to set aside the abatement caused due to the death of the deceased second respondent; and to bring on record the legal heirs of the deceased second respondent as respondents 9 to 12 in the above appeal.

2. Heard Mr.P.G.Kumaraguru, learned counsel for the petitioners, Mr.N.C.Ashok Kumar, learned counsel for the first respodnent and Mr.T.Saravanan, learned counsel for the second respondent . The learned counsel for respondents has no objection for these petitions being allowed.

3. Considering the submissions made on either side and being satisfied with the reasons stated in the affidavit filed in support of these petitions, the delay is condoned and the petitions are allowed. The Registry is directed to carry out the necessary amendment. Post the appeal on 14.06.2024.
