PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to call for the entire records pertaining to FIR. No.347 of 2019 dated 02.12.2019 registered on the file of the respondent and to quash the same insofar as the petitioner is concerned. For Petitioner : No Appearance.

ORDER

No representation for the petitioner. This petition is filed to quash the complaint given by the driver of the State Transport Corporation reporting the damage caused to the bus by the petitioner herein and attacked him contending that a spontaneous protest by the public for arrest of one Nagai Thiruvalluvan by the Coimbatore Police, the said incident has occurred and whereas, the petitioner is no way connected with the occurrence, she being the first generation Law Graduate and awaiting for enrollment, case has been foisted against her.

2. The learned Government Advocate (Crl.Side) submits that tentative evidence of the damage to the public property and the instigation of the petitioner to others to damage the property are well found in the investigation. Final report is ready and kept pending for the disposal of this petition.

3. Considering the material available in the CD file collected during the course of investigation, this Court finds that this case does not comes within the Page No.2/4

parameters laid by the Hon'ble Supreme Court in the case of Neeharika Infrastructure Pvt Ltd., /Vs/ State of Maharashtra and Others reported in 2021 SCC Online SC 315. Hence, this petition is dismissed.
