This Court by the order dated 03.04.2019 has directed the learned Judicial Magistrate No.II, Puducherry to dispose of the case in C.C.No.170 of 2015 within six months from the date of receipt of copy of the said order. But the learned Judicial Magistrate No.II, Puducherry by her letter dated 04.11.2019 has stated that the summons which were sent to L.Ws.1 to 4 returned as "unserved". She has not furnished the details as to when she received the copy of the order from this Court and thereafter when she issued summons to the witnesses. She has not furnished the details by hearing datewise. So, it appears that for the past eight months, the concerned Magistrate has not taken effective steps to dispose of the case. Hence, the concerned Magistrate is directed to dispose of the aforesaid case within three months from the date of receipt of copy of this order as finally, by posting the case by giving short dates. Further, the concerned Magistrate is directed to address the concerned Superintendent of Police through the Chief Judge, Puducherry requesting him to give 1/3
suitable instructions to the concerned police to produce the witnesses. Further the concerned Magistrate is directed to dispose of the case within three months without giving unnecessary adjournments. 10.01.2020 mfa Note: Issue order copy on 13.01.2020.
