CR.NO.7 OF 2010.

Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed by this Hon'bel Court totally in Crl.M.P.No.6635 of 2017 dated 24.05.2017 in Crl.A.No.273 of 2017. [IN CRL.MP.NO.14075 OF 2017] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.A.RAJA MOHAMED, Advocate for the petitioner and of MR.P.GOVINDARAJAN ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- Seeking to relax the condition imposed by this Court in Crl.M.P.6635 of 2017 in Crl.A.No.273 of 2017, dated 24.05.2017 the petitioner/appellant is before this Court with this petition.

2. This Court by an order dated 24.05.2017 imposed conditions to the petitioner that the petitioner executes a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of learned Special Judge / Chief Judicial Magistrate, Thiruvallur and the petitioner / appellant shall report before the concerned Court twice in a month, i.e., on the 1st and 15th of every English Calendar month, at 10:30 a.m., until further orders.

3. The learned counsel appearing for the petitioner submitted that the petitioner is the sole bread winner of the family and due to this condition, the petitioner is suffering economically and physically. Hence, this condition may be relaxed.

4. The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner has been regularly complying with the condition imposed by this Court on 24.05.2017 from 01.06.2017 to till date.

5. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

6. Considering the facts and circumstances of the case and taking note of the submissions made by the learned counsel appearing on either side, one of the conditions imposed by this Court on 24.05.2017 that the petitioner shall report before the concerned Court twice in a month i.e., on the 1st and 15th of every English Calendar Month at 10.30 a.m., until further orders is modified to the effect that the petitioner shall report before the concerned Court viz., the learned Special Judge/Chief Judicial Magistrate, Thiruvallur, on the 15th of every English Calendar month, at 10:30 a.m., until further orders."

7. Accordingly, this criminal miscellaneous petition is modified.
