These petitions are filed (i) to condone the delay of 3922 days in filing the petition to set-aside the order of abatement caused due to the death of 2nd respondent, (ii) to set-aside the order of the abatement caused due to the death of the second respondent and (iii) to bring on record the respondents 4 and 5 herein as the legal representatives of the deceased 2nd respondent and rank them as respondents 4 and 5 in S.A.No.519 of 2007, respectively.
2.Though the names of the proposed respondents 4 and 5 are printed in the cause list after serving notice to them, there is no representation on behalf of them. The learned counsel for the other respondents did not raise any serious objection and this Court is satisfied with the reasons assigned in the affidavit filed in support of these petitions. Hence, these petitions are allowed. 3.The Registry is directed to carryout necessary amendments in the Second Appeal No.519 of 2007 and list the matter for final hearing in the first week of June 2023.
