Criminal Original Petition filed under Section 482 of Cr.P.C., praying to direct the respondent to register a FIR based on the complaint of the petitioner dated 23.06.2016, investigate the same, according to law against the accused person.

O R D E R

The Criminal Original Petition has been filed to direct the respondent to register a FIR, on the complaint dated 23.06.2016, given by the petitioner and to investigate the same.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. When the matter is taken up for hearing, the learned Additional Public Prosecutor submitted that there is a complaint and counter complaint, inasmuch as the petitioner has given a complaint against her husband Muthukumar, and Muthukumar has given a complaint against the petitioner, and two CSRs are pending viz., CSR.154 & 155 of 2016.

4. Mr.A.V.Surya Prakasam, the learned counsel for the petitioner submitted that the petitioner has been injured and therefore, the Police should have to register an FIR. https://hcservices.ecourts.gov.in/hcservices/

5. The learned Additional Public Prosecutor submitted that petition enquiry was conducted and the same was closed 25.06.2016.

6. In view of the above, the respondent Police is directed to re-open the enquiry in both the CSR.Nos.154 & 155 of 2016 and take action in accordance with law. With the above direction, this Criminal Original Petition is closed.
