Heard Mr.V.Prakash, learned senior counsel for the petitioner and Mr.M.Maharaja, learned Standing Counsel appearing for the respondent Department.

2. The petitioner seeks for a Mandamus directing the respondent to consider their representation dated 07.08.2017 wherein and whereby, they sought for deletion of S.No.280/1 measuring an extent of 0.12.0 ares in Adigathur Village, Tiruvallur District, from the ban order issued by the respondent on 28.07.2015.

3. The grievance of the petitioner is that the said representation has not been considered by the respondent so far. Therefore, without expressing any view on the merits of the claim made by the petitioner, this Writ Petition is disposed of only with a direction to the respondent to consider the said representation of the petitioner dated 07.08.2017 and pass orders on the same on merits and in accordance with law after giving due opportunity of hearing to the petitioner. Such exercise shall be done by the respondent within a period of four weeks from the date of receipt of a copy of this order. It is made clear that this Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the respondent to consider and decide. No costs.
