Mr.M.Chidambaram, learned counsel for the petitioner, Mr.G.Senthilkumar party in person/second respondent and Mr.M.Thamim Basha, Superintendent Legal, MTC, Chennai Limited are present.
TERMS OF SETTLEMENT After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

"Ït is submitted that the 2nd respondent workman agreed to forego the entire back wages from the date of removal (i.e) from 13.01.2012 to till the date of reinstatement without continuity of service with a condition that the 2nd respondent may be reinstated into service as a fresh entrant as Daily Paid Conductor and the Management/Petitioner also agreed the proposal of the 2nd respondent/workman".
3. Both parties are arrived at settlement terms willingly before the Lok Adalat held on 24.02.2022 at 1.00 p.m. No coercion of force is applied to arrive at settlement. This case may be disposed of, as settled accordingly.
4. Both parties have filed a Joint Memo of Compromise and the same is recorded and shall part of the award. Consequently, connected Miscellaneous Petitions are also closed.
5. The full Court fee shall be refunded to the petitioner in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994 and there shall be no demand for additional Court fee.
