Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying to to issue a writ of mandamus, directing the second respondent to consider the petitioner's representation dated 12.02.2015 and issue relieving order to the petitioner within a time stipulated.

ORDER

This writ petition is filed seeking a mandamus directing the second 1/5

respondent to consider the petitioner's representation dated 12.02.2015 within a time stipulated by this Court.

The facts in brief, as per the affidavit filed in support of this writ petition, are as follows:

The petitioner was appointed as Village Administrative Officer (VAO) at Metarathi as per the appointment order dated 15.02.2009 in proceedings No.1357/09/A4 and he served for three years.

A Memo was served on the Petitioner by the Revenue Divisional Officer on 22.01.2010 vide Na.Ka.No.132/2010/Aa to write special examination on the subjects of duties of Village Administrative Officer (VAO), Rural General Sanitation, etc., which was scheduled to be held on 23.01.2010 and 24.01.2010. Accordingly the petitioner appeared in the said examination. 2.3.

However, on account of the petitioner's ill health, he could not continue in his service. He was allotted some other village by the Revenue Divisional Officer and the petitioner has requested for voluntary retirement on the ground of medical invalidation, with effect from 30.11.2010. 2.4.

But the petitioner did not receive any relieving orders. He sent a representations on 27.03.2014 and on 12.02.2015 to the first respondent 2/5

requesting to issue relieving orders. Since there was no response, the Petitioner has filed this writ petition.

Learned counsel for the respondents 1 and 2 have submitted that proceedings will be issued by considering the representation of the petitioner in respect of the relieving order sought by her. 4.

Considering the facts and circumstance and also taking into consideration the submissions made by both the learned counsel, this writ petition is disposed of directing the respondents to consider the petitioner's representations dated 27.03.2014 and 12.02.2015 on merits and in accordance with law and dispose of the same as quickly as possible at any rate not later than four weeks from the date of receipt of copy of the this order.
