86, 14TH FLOOR, RAJAJI SALAI, CHENNAI 1 2 THE REGIONAL MANAGER, REGIONAL BUSINESS OFFICE, REGION IV, STATE BANK OF INDIA, 1572 A, 2ND FLOOR, PANDURANGAN TOWERS, INDIRA NAGAR EAST, VENGIKKAL, TIRUVANNAMALAI 606 604 Writ Petitions under Article 226 of the Constitution of India praying that in the circumstances stated therein and in the respective affidavits filed therewith the High Court will be pleased to (i) issue writs, orders or directions and more particularly to issue a writ in the nature of declaration, declaring that the order of the 2nd respondent dt 28.5.2018 bearing No.RBO-IV/2018-19/HR/11/306 as illegal, arbitrary, contrary to law and consequently direct the respondent Bank to regularize the leave availed by the petitioner, hold that the voluntary retirement application dt 20.2.
2018 of the petitioner is deemed to have been accepted by the respondent Bank or in the alternative direct the 2nd respondent Bank to accept the Voluntary Retirement Application of the petitioner dt 20.2.2018 and relieve the services of the petitioner from respondent Bank and settle all the terminal benefits to which the petitioner is entitled (in WP.21245/2018) and (ii) grant interim injunction restraining the respondents from initiating any action against the petitioner for not joining duty, without considering the application of the petitioner for Voluntary Retirement (in WMP.24910/2018) pending disposal of the above WP.No.21245/2018.
Order : These petitions coming on for orders upon perusing the petitions and the respective affidavits filed in support thereof and upon hearing the arguments of M/S.BALAN HARIDAS, Advocate for the petitioner in both the petitions and of M/S.C.K.CHADRASEKARAN, https://hcservices.ecourts.gov.in/hcservices/
Advocate for the 2nd respondent in both the petitions the court made the following order:- The Interim stay already granted shall stand suspended to enable the Bank to proceed against the petitioner for a minor penalty proceeding and they are directed to issue notice in this regard within three days from the date of receipt copy of this order and the petitioner shall give explanation within one week thereafter and on consideration of the explanation given by the petitioner, the Bank is directed to pass orders within a period of two weeks thereafter. 2.List the matter on 05.08.2019 for further orders. -sd/- 01/07/2019 / TRUE COPY / Sub-Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
