ORDER
(Order of the Court was made by Dr.Anita Sumanth J.) The challenge is to an order dated 31.12.2025 rejecting the request of the petitioner for ordinary leave of 28 days to her husband, who is a life convict, presently confined with Central Prison, Vellore (Convict). As on date, the convict has undergone sentence of 9 years 7 months and 14 days. The last leave availed by the convict ended on 26.09.2024 and hence he is entitled to ordinary leave of 28 days as per Rule 22 of the Tamil Nadu Suspension of Sentence Rules, 1982 (in short 'Rules').
2. The reasons assigned in the impugned order of rejection are that i) the adverse report of the Probation Officer and ii) the pendency of an alternate case in C.C.No.639 of 2022 on the file of District Munsif-cum-Judicial Magistrate, Madhavaram.
3. As far as the second objection is concerned, the convict has been acquitted on 12.01.2026, subsequent to the date of impugned order and hence that objection goes.
4. As far as the first objection is concerned, we do not find any merit in the same, as the Probation Officer has himself opined that the petitioner (convict's wife) is keeping unwell and has been advised to undergo surgery.
5. In light of the aforesaid, the reasons assigned in the impugned order dated 31.12.2025 do not appeal us and hence the same is set aside. This Writ Petition is allowed and the convict is granted ordinary leave of 28 days without escort, though on the following conditions:
(i) Respondents are directed to release the Convict Prisoner viz., Karthi, S/o. Ramalingam @ Eli Ramalingam, aged 45 years, confined at Central Prison, Vellore on Ordinary Leave for a period of 28 days i.e., from 24.03.2026 to 20.04.2026.
(ii) The Convict Prisoner shall be released on 24.03.2026 at 10.00 am and he shall surrender before the Superintendent of Prisons, Central Prison, Vellore on 21.04.2026 before 10.00 a.m. (iii) The Convict Prisoner is directed to report before the Inspector of Police, Guduvanchery Police Station every alternate day at 10.30 a.m., during the period of leave.
(iv) The Convict Prisoner shall utilize the leave only for the ground on which it has been granted and shall not indulge in any other activities.
