Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents to disburse 6 % interest for belated payment of provident fund, gratuity and earned leave surrender and consequently direct the respondents to 1/6

settle the unpaid benefits of surrendered leave salary and last 11 days salary within stipulated time.

O R D E R

This writ petition is filed for the following relief: "To direct the respondents to disburse 6 % interest for belated payment of provident fund, gratuity and earned leave surrender and consequently direct the respondents to settle the unpaid benefits of surrendered leave salary and last 11 days salary within stipulated time".

2. The case of the petitioner is that he was appointed as a Conductor in the respondent corporation on 20.03.1996 and retired from service on attaining the age of superannuation on 31.05.2024. However, the terminal benefits have been settled to the petitioner only on 02.12.2025 and no interest has been paid for the delayed period. 2/6

Further, he was not paid surrendered leave salary and last 11 days salary. Therefore, the petitioner had submitted a representation to the respondents to sanction unsettled amount and disburse the interest for the delayed period. Since the same was not considered, the present writ petition has been filed.

3. Heard the learned counsel for both sides and perused the materials available on record.

In view of the limited request made by the petitioner with regard to interest on the belated settlement of retirement benefits, this Court directs the respondents to pay interest at the rate of 6% p.a. for the belated payment of retirement benefits from the date of retirement to till the date of actual disbursal of the retirement benefits of the petitioners and also to consider the issue in regard to disbursement of the unpaid salary as stated supra, if there is no other impediment in disbursing the same, within a period of six weeks from the date of receipt of a copy of this order, taking into account the bank rate of interest on deposits.

5. With the above direction, this writ petition is allowed. No costs.
