ORDER
The petitioners, who were arrested and remanded to judicial custody on 20.01.2026 for the alleged offences under Section 8 (c), 8 (b), 20 (a) (1), 20 (b) (ii) (B), 29 (1) and 25 of NDPS Act, 1985, in Crime No.35 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioners along with other accused were found in illegal possession of 1.500kgs of ganja. Hence the case.
3.The learned counsel for the petitioners submitted that the petitioners are innocent and have been in custody since 20.01.2026. He further submitted that they are ready to abide by any stringent conditions that may be imposed by this Court and are ready to co-operate with the investigation. Hence, he prays to grant bail to the petitioners.
4.The learned Government Advocate (Criminal Side) appearing for the respondent police would strongly opposed the petition on the ground that these petitioners have got five previous cases, including one murder case and one NDPS case. However, he submitted that there is no recovery from these petitioners and that what was recovered from another accused A1 is an intermediate quantity.
5.Taking into consideration of the totality of the circumstances, and the involvement of contraband is only intermediate quantity, the submissions made by the learned counsel and the period of incarceration undergone by the petitioners, this Court is inclined to grant bail to the petitioners with certain conditions.
6. Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only) each, with two sureties each for a like sum to the satisfaction of the
learned XIII Metropolitan Magistrate, Egmore, and subject to the following conditions:
[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioners shall report before the respondent police in the morning at 10.30 AM and evening at 5.30 PM until further orders; No petition for relaxation of conditions shall be filed for a period of sixty days; [c] the petitioners shall not abscond either during investigation or trial;
[d] the petitioners shall not tamper with the evidence or witness either during investigation or trial; [e] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions had been imposed and the petitioners released on bail by the learned Magistrate/Trial Court itself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[f] if the petitioners thereafter abscond, a fresh FIR may be registered under Section 269 of the Bharatiya Nyaya Sanhita, 2023.
