ORDER

(Heard through video conferencing) This Civil Revision Petition has been filed against the order of the learned Judicial Magistrate-cum-District Munsif Court, Parangipettai, on the order of the return of the unnumbered plaint dated 04.10.2016. 2.

The plaint has been returned for certain defects to be complied. Now the learned counsel for the petitioner submitted that he could not comply the returns because he did not have the required documents to be represented along with the plaint and comply the return remarks. But he has further submitted that he has got the relevant documents now and he would choose to file a fresh suit.

By so stating, the learned counsel for the petitioner requested permission of this Court to withdraw this Civil Revision Petition. It is up to the petitioner to get leave of this Court to withdraw the petition, but however his right to file a fresh suit will be subject to the period of limitation, maintainability of the suit, etc., With these observations, the Civil Revision Petition the petitioner is permitted to withdraw the Civil Revision Petition. 2/4

In the result, these Civil Revision Petition is dismissed as withdrawn. No costs.
