The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to pay the difference of amount in leave salary and pension arrears as per 14th wage settlement dated 24.08.2022 and the difference in gratuity based on increased DA with 10% interest to the petitioners.

The case of the petitioners are that the petitioners were joined in the 1st respondent Transport Corporation as Conductors, Drivers and Technical Staff on various dates and retired from service on various dates. The petitioners made a representations to the respondents dated 08.11.2024, 11.11.2024, 13.11.2024, 21.11.2024, 25.11.2024, 27.11.2024, 06.12.2024 and 09.12.2024, to pay the difference of amount in leave salary and pension arrears based on 14th wage settlement dated 24.08.2022 and the difference in gratuity based on increased D.A., with 10% interest. The said representations are pending on the file of the respondents. Hence the present writ petition is filed.

3. The learned Standing Counsel for the respondents would fairly admits that in view of the similar orders passed by this Court in W.P.Nos 40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.
4. Heard the learned counsel for both sides and perused the materials available on record.

In view of the above submission of the learned Standing Counsels, this Court deems it appropriate to direct the respondents to pay the eligible and admissible amount with interest at the rate of 6% per annum for the belated payment of terminal benefits, from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners, within a period of six weeks from the date of receipt of a copy of this order. 4/7
6. In the result, this Writ Petition is disposed of with the above observations. No costs.
