This Criminal Miscellaneous Petition has been filed seeking relaxation of the condition imposed by this Court in Crl.O.P.No.17489 of 2008 dated 1 / 4

2. The learned counsel for the petitioner submitted that the said condition was imposed as early as in the year 2008. He further submitted that the charge sheet has already been filed and the trial is yet to commence, and summons have been issued to the witnesses. Hence, considering the long pendency of the matter, the petitioner seeks relaxation of the condition imposed by this Court, more particularly to return the certificate furnished towards property security.

3. At this juncture, the learned Government Advocate (Crl. Side) appearing for the respondent police invited the attention of this Court to the earlier order dated 11.08.2022 passed in Crl.M.P. No.12542 of 2022 in Crl.O.P. No.17489 of 2008, wherein a similar request made by the petitioner was dismissed on the ground that the petitioner had failed to produce a proper valuation certificate issued by the competent authority. This Court, while dismissing the said petition, had granted liberty to the petitioner to file a fresh petition with a proper valuation certificate obtained from the authority concerned.

4. Even now, the petitioner has not produced any valuation certificate from the competent authority, as required by this Court in the earlier order. Therefore, in the absence of compliance with the said condition, this Court is not inclined to grant the relief sought for.
