Respondent Writ Petition filed under Article 226 of the Constitution of India seeking for the relief of issuance of writ of mandamus to direct the respondent herein to issue the education loan application to the petitioner and to further process the same for the grant of educational loan.

ORDER

This writ petition has been filed by P.Gowthaman, who is studying Hotel Management and Catering Technology in Barath Institute of Catering Technology and Hotel Management, Thanjavur, three year diploma course with dual mode of B.Sc. (Catering and Hotel Administration), for a direction to the respondent Bank to issue educational loan application and thereafter to process further for grant of educational loan.

2.Learned counsel appearing for the petitioner submits that the petitioner joined Barath Institute of Catering Technology and Hotel Management, Thanjavur by mobilising a sum of Rs.22,000/- towards semester fees. Since the petitioner's family is not in a position to pay the tuition fees and other fees for the next semesters, the petitioner approached the respondent Bank for educational loan by making a representation dated 28.05.2015. Therefore, the grievance of the petitioner is that even after receipt of the representation, he has not been furnished with loan application. Hence he has come up with this writ petition.

3.Mr.F.B.Benjamin George, learned counsel for the respondent Bank would submit that the petitioner, without approaching the respondent Bank properly, has come to this Court. However, he would submit that if the petitioner approaches the Bank with a proper application along with requisite documents, his request for educational loan would be considered.

4.Considering the submissions made by the learned counsel on either side, this Court directs the petitioner to download the application and approach the respondent Bank along with requisite documents. On such application being made by the petitioner, the respondent Bank shall consider the same and pass appropriate orders within a period of four weeks from the date of receipt of application. 5.With the above direction, the writ petition is disposed of. No costs.
