...Defendants Prayer: This Civil Suit is filed under Order VII Rule 1 of the Code of Civil Procedure r/w Order IV Rule 1 of the Madras High Court O.S.Rules Sec.7 of the Commercial Courts Act No.04 of 2016 and Sec.51, 55 & 62 of The Copyright Act, 1957, praying to pass the judgment and decree:- (i) for a declaration that the plaintiff is the sole and exclusive owner of the copy right in respect of the distribution, exhibition and exploitation rights of the film titled " KARUNKAPPIYAM" (Tamil, Colour) for the areas of all over Tamil Nadu, Puducherry, Kerala State and Karnataka State as known in the film trade:

(ii) for permanent injunction restraining the defendants, their agents, servants, distributors or anybody claiming through or under them from in any manner infringing the copyright of the plaintiff either by releasing, distributing, exploiting the film titled "KARUNKAPPIYAM" (Tamil, Colour) anywhere in the areas of all over Tamil Nadu, Puducherry, Kerala State and Karnataka State or dealing with the said rights in any manner whatsoever;
