Civil Revision Petition filed under Article 227 of the Constitution of India against the fair and decreetal order dated 31.07.2014 passed in I.A.No.46 of 2014 in A.S.No.9 of 2013 by Principal District Judge of Perambalur. For Petitioner : Ms.P.Veena
O R D E R
The revision petitioner is the plaintiff in O.S.No.15 of 2010 on the file of SubCourt, Perambalur. It is a partition suit. The suit was dismissed on the ground that she is an illegitimate daughter of the first respondent and she cannot claim the properties during the life time of the first respondent.
2. The revision petitioner filed A.S.No.9 of 2013 against the judgment and decree dated 14.02.2013 passed in O.S.No.15 of 2010.
3. In the mean while, the revision petitioner filed I.A.No.46 of 2014 in A.S.No.9 of 2013 under Rule 75 of Civil Rules of Practice, to issue summons to the Tahsildar, Veppanthattai to produce certified copies of some original
D.HARIPARANTHAMAN,J., svki document. The Appellate Court, by an order dated, 31.07.2014 rejected the same. This revision petition is against the aforesaid order, dated 31.07.2014 made in I.A.No.46 of 2014 in A.S.No.9 of 2013.
4. Heard the learned counsel for the petitioner.
5. The Appellate Court came to the conclusion that since the document sought to be produced was public in nature, there was no need for production of such document.
6. I do not find any infirmity in the order passed by the learned Principal District Judge, Perambalur. If the petitioner produces certified copy of the public document in the manner known to law, the Appellate Court would consider the same.
With the above observation, this Civil Revision petition stands dismissed. No costs.
