O R D E R

Heard Mr. J.Lakshminarayanan, learned counsel for the petitioner, Mr. Venkatesa Perumal, learned counsel who takes notice on behalf of the first respondent and Mr. C.S.K.Sathish, learned counsel who takes notice on behalf of the third respondent and perused the materials placed on record, apart from the pleadings of the parties.

2. This writ petition is filed for mandamus directing the respondents to pay interest to the petitioner at the rate of 8% per annum for the belated payment of his commutation amount.

3. When the matter came up for hearing, the learned counsel appearing for the respondents fairly submit that, in these cases, this Court has consistently allowed the payment with interest at the rate of 6% per annum.

4. In that view of the matter, this writ petition is disposed of on the following terms:

(i) the respondents are directed to calculate and disburse the interest at the 2/4

rate of 6% per annum on the belated payment on commutation amount from the date it became due till the date of disbursement within a period of twelve (12) weeks from the date of receipt of a copy of this order with interest; and (ii) if the amount is not paid within a period of twelve (12) weeks, thereafter, interest at the rate of 12% per annum from the date it became due till the date of disbursement shall be paid.

No costs.
