This writ petition has been filed for issuance of a writ of mandamus to direct the third respondent to consider the representation dated 10.09.2024 forwarded by the 4th respondent and sanction revised scales of pay of Rs.9300/34800+GP4200 to the petitioners as per letter No.23802/CMPC/2011-1 dated 23.05.2011 issued by the first respondent.
2. In the affidavit filed in support of the writ petition, it had been contended that the petitioners have been appointed as Lab Assistant and 2/5
had been working under the 4th respondent College. They had been placed under the pay scale of Rs.5200-20200+G.P.2400 and have granted selection grade also. It is contended that the first respondent had issued a letter on 23.05.2011 revising the scale of pay for Lab Assistant in Government and Government Aided College. It had been further stated that the petitioners are also entitled for revision of pay. They had given a representation in this regard. The learned counsel for the petitioner submitted that the representation may be considered.
3. On the side of the respondents, reliance had been placed on the order of a learned single Judge in Cont.P.No.2216 of 2018 in the case of P.Kesavan Vs Principal Secretary, Finance (CMPC) Department, Government of Tamil Nadu, Secretariat, Chennai and another consequent to the order dated 15.02.2024 in WP.No.18416 of 2018.
4. In the contempt petition, it had been noted that the representation which had been directed to examine had been rejected by the respondents. The respondents may examine the representation now given by the 3/5
petitioners and pass an appropriate order within a period of six weeks from the date of receipt of a copy of this order.
