Mr.K.Srinivasan Special Public Prosecutor (for Cbi Cases) COMMON ORDER Crl.M.P.No.5369 of 2025 is filed by the petitioner/Velmurugan/A4 in C.C.No.37 of 2017 seeking to condone the delay of 68 days in filing a revision in Crl.R.C.SR.No.14400 of 2025.

2.Crl.M.P.No.5364 of 2025 is filed by the petitioner/Ayyappan/A5 in C.C.No.37 of 2017 seeking to condone the delay of 69 days in filing a revision in Crl.R.C.SR.No.14394 of 2025.
3.The learned Special Public Prosecutor appearing for the respondent submitted that in this case, all the accused filed a discharge petition before the trial Court, which were dismissed by the trial Court on 19.09.2024 by a separate order, against which, the co-accused A2 filed Crl.R.C.No.1822 of 2024, A3 filed Crl.R.C.No.1656 of 2024, A8 and A9 filed Crl.R.C.No.2413 of 2024 and A10 and A11 filed Crl.R.C.No.169 of 2025 before this Court. Aggrieved against the dismissal of the discharge petition, the petitioners/A4 and A5 filed the present revisions with a delay of 68 and 69 days, respectively. The petitioners applied for the certified copy of the order on 20.09.2025 and received the order copy on 24.09.2024. The affidavits filed for condonation of delay are identical and one and the same, which would 3/6
clearly go to show that the affidavits are not truthful and these petitions were filed only to drag on the proceedings in C.C.No.37 of 2017. In this case, charge sheet filed and more than 7 years have lapsed, but still the trial is yet to commence. Further, in this case, already this Court granted protection order directing the trial Court not to frame charges against the accused persons. Taking advantage of the same, to further drag on the proceedings, the present petitions are filed without any reason. He further submitted that in the revisions filed by the co-accused, which were already numbered, counter has been filed and it is ready for arguments. Again citing the above reason, further time is sought, which is not permissible. Hence, he strongly opposed the same.
4.Though the learned Special Public Prosecutor's objection is reasonable, in the interest of justice, to give an opportunity to the petitioners, the delay stands condoned and the petitions are ordered. 4/6
5.Registry is directed to number these Criminal Revision Petitions, if they are otherwise in order and post the same for Admission on 27.03.2025 at 2.30 p.m. along with connected Crl.R.C.Nos.1656, 1822, 2413 of 2024 and 169 of 2025.
