The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002 and Section 506(i) of IPC in Crime No.5 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had one side love with the defacto complainant. Further, when the parents of the defacto complainant arranged her marriage with another person, the petitioner contacted the bridegroom and spoken ill of her character and sent the photographs which he had taken with the defacto complainant during his stay in her house, due to which, the marriage was cancelled. Thereafter, the petitioner also threatened the defacto complainant and her family members with dire consequences. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. The learned counsel further submitted that this is the 4th bail application and the earlier applications were dismissed by this Court and prayed for grant of anticipatory bail.

The learned Government Advocate submitted that on the earlier occasions, considering the serious allegations, this Court dismissed the petition and there is no change in circumstances after the previous orders were passed on merits. Hence, the learned counsel vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and that the allegation of the petitioner is heinous one and further, there is no change of circumstances arises for considering the 4th anticipatory bail petition. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
