O R D E R
(The case has been heard through video conference) This Writ Petition has been filed seeking a direction directing the respondents to consider and dispose the petitioner's representation dated 25.06.2018 within a time frame fixed by this Court.
2. The grievance of the petitioner is that the petitioner's father was in possession and enjoyment of the property in R.S. No. 203/9A. While issuing patta, inadvertently, the petitioner's uncle, one Munusamy name was also included in the patta and to delete his name the petitioner has submitted his representation https://hcservices.ecourts.gov.in/hcservices/
before the 2nd respondent. Pursuant to the same, the 2nd respondent has also called for enquiry and the petitioner has also appeared for enquiry, but, so far, no order has been passed. Hence, the present writ petition has been filed by the petitioner.
3. Today, when the matter was taken up for hearing, the learned Special Government Pleader appearing for the respondents submitted that the land in dispute is a natham land and joint patta has been issued in name of petitioner's father and one Munusamy. Now, to remove the name of Munusamy, the enquiry was conducted and the enquiry is posted for further hearing on 15.05.2021 and after completing enquiry, the 2nd respondent will pass suitable orders.
4. Considering the fact that the enquiry was already commenced, the 2nd respondent is directed to complete the enquiry and pass suitable orders on merits in accordance with law after hearing the petitioner as well as Munusamy, rival claimant within a period of twelve weeks from the date of receipt of a copy of this order. Accordingly, this Writ Petition stands disposed of. No costs.
