Application No. 2397 of 2024 in C.S. No. 228 of 2023 C.V.KARTHIKEYAN, J.

This application has been filed seeking to condone the delay of 41 days in filing the written statement filed on behalf of the first defendant.

2. In the affidavit filed in support of the application, it had been stated that the property had already been sold and all the documents had been handed over to the second defendant. It has also been stated that the applicant /1st defendant is a senior citizen of advanced age and was not able to immediately give instructions to the counsel.

3. Heard the learned counsel for the plaintiff.

4. Taking into consideration the reasons advanced, the delay is condoned.

5. Registry to take into consideration the written statement filed by the first defendant.
