CMP No.11208 of 2021 in SA Nos.181 & 182 of 2008 MUMMINENI SUDHEER KUMAR.J., This petition has been filed to strike out the names of the respondents 3 to 8 in the above Second Appeal nos.181 & 182 of 2008. 2.On perusal of the affidavit and from the averments made therein and submissions of the learned counsel for the petitioner, it appears that the respondents 3 to 8 were the tenants of the lands which are subject matter of the suit when the original suit was filed and they are no more in possession of the same. The question of striking of the names, at the instance of the petitioner herein, who is one of the defendant, does not arise. However, as the petitioner / appellant is not intending to pursue the second appeal as against the respondents 3 to 8 and the same is accepted. The Second Appeal nos.181 & 182 of 2008 are dismissed as not pressed as against the respondents 3 to 8.
