Criminal miscellaneous petition filed under Section 528 of BNSS, seeking to relax the condition imposed that 'The petitioner is directed to appear before the 2nd respondent police daily at 10.30 am until further orders on 1st and 15th day of every month at 10.30 am until further orders' in Crl.M.P.No.21272 of 2025 dated 13.11.2025 in Crl.A.No.1396 of 2025. ORDER
Vide order dated 13.11.2025 made in Crl.M.P.No.21272 of 2025 in Crl.A.No.1396 of 2025, this Court had modified the condition pertaining to the appearance of the petitioner imposed by this Court, vide order dated 16.09.2025 made in Crl.A.No.1396 of 2025 while granting bail. This criminal miscellaneous petition has been filed by the petitioner seeking relaxation of the said condition.
2. Learned Government Advocate (Crl. Side) appearing for the 1st and 2nd respondents, on instructions, submitted that the petitioner has been complying with the conditions without fail, except on one occasion.
3. In view of the above submission made by the learned Government Advocate (Crl. Side), this Court is inclined to modify the condition imposed as regards the appearance of the petitioner and which was subsequently modified by this Court.
4. Accordingly, the condition insofar as appearance as imposed by order dated 13.11.2025 alone stands modified and the petitioner shall appear before the trial court on the 1st working day of every English 2/4
calendar month at 10.30 am until further orders. All other conditions remain unaltered.
