ORDER
This writ petition has been filed seeking to direct the 1st respondent to take necessary action on the petitioner's representation dated 06.11.2022 by virtue of the patta. A- Register, within the stipulated time as prescribed by this Court.
2.Learned counsel for the petitioner would submit that the petitioner made a representation dated 06.11.2022 seeking to remove the encroachment in the petitioner's property and to take action against the encroachers. Since the same was not considered, the present writ petition has been filed. 3.Learned Additional Government Pleader appearing for the respondents 1 to 5 would submit that the issue of the petitioner is to remove the encroachment made in the land assigned to the petitioner. The said issue has to be agitated before the Civil Court.
4.In reply learned counsel for the petitioner would submit that the petitioner has succeeded in the civil suit. Therefore, to remove all the encroachment, he has made a representation.
5.Heard the learned counsel for the petitioner, learned Additional Government Pleader appearing for the respondents 1 to 5 as well as the learned counsel for the respondents 6 and 7.
6.Considering the submissions made by either parties, this Court is of the view that if the petitioner succeeded in the civil suit, the right course available for the petitioner is to file the Execution Petition to remove the encroachment.
