O R D E R

This Writ Petition has been filed to direct the first to third respondents to accord permission to the petitioner to install a CCTV camera on the terrace of the property situated at Door No.9A, Achuthan Nagar, 3rd Street, Ekkattuthangal, Chennai - 600032.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first to third respondents and perused the materials available on record.

3. It is seen that the petitioner had purchased the subject property by way of sale deed dated 02.07.2021, vide registered Document No.6937 of 2021. However, the said sale deed is under challenge by the fourth respondent in O.S.No.8697 of 2021 on the file of the XV Additional City Civil Court, Chennai. In the meanwhile, the petitioner intended to install a CCTV camera on the terrace of the subject property. 2/5

4. While that being so, the fourth respondent is obstructing the same. Therefore, the petitioner sought permission from the first to third respondents to install a CCTV camera. The dispute between the petitioner and the fourth respondent is civil in nature in respect of the subject property. Therefore, the first to third respondents have no role to play in the civil dispute pending between the petitioner and the fourth respondent. That apart, the petitioner is always at liberty to install a CCTV camera in his property and need not seek any permission from the police. If at all there is any obstruction at the hands of the fourth respondent, the petitioner is directed to approach the civil court for appropriate relief.

5. With the above directions, this Writ Petition is disposed of. No costs.
