This Civil Miscellaneous Petition is filed to condone the delay of 1693 days in representing the above Cross Objection SR.No.30631 of 2017 in A.S.No.666 of 2016.

2.The learned counsel appearing for the petitioner submitted that due to the death of the clerk who was dealing with the matter, the return papers could not be represented in time and hence, the delay of 1693 days has occurred and prayed for allowing this petition on terms and submitted that the petitioner will pay a sum of Rs.5,000/- as cost for condoning the delay.

3.Heard the learned counsel appearing for the petitioner.

4.Being satisfied with the reasons stated in the affidavit filed in support of this petition and the submissions of the learned counsel appearing for the petitioner, the delay of 1693 days is condoned on payment of cost of Rs.5,000/- (Rupees Five Thousand only) to "the Hon'ble Chief Justice Relief Fund, High Court, Madras", within a period of one week from the date of receipt of a copy of this order, failing which this petition shall stand dismissed automatically without further reference to this Court.
