Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 2nd respondent i.e. the Tahsildar, The Tahsildar, Sholinganallur Taluk, Kancheepuram District to consider the Application / representation dated 15.02.2020 given by the petitioner and to issue patta within the time limit fixed by this Hon'ble Court. O R D E R
The petitioner has filed this writ petition seeking issuance of a Writ of Mandamus to direct the 2nd respondent to consider the petitioner's representation dated 15.12.2020 and issue patta in favour of the petitioner.
2. The case of the petitioner is that one Balakrishnan, brother of the petitioner's grandfather is the owner of the property comprised in S.No.126/1, Santhosh Nagar, Perungudi, measuring an extent of 1 Acre 70 cents situated at Palavakkam Village, No.112 Sholinganallur Taluk, South Chennai District. Whileso, the petitioner approached the 2nd respondent and requested to survey the disputed property and de-mark boundaries, however, the same was not considered by the 2nd respondent, on the ground that the patta stands in the name of the petitioner's grandfather. Therefore, the petitioner made a representation dated 15.12.2020 for transfer of patta in respect of the subject property, however, till date, no orders have been passed on the same. Hence, the present Writ petition is filed.
3. Though very many grounds have been raised, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the 2nd respondent to consider the petitioner's representation dated 15.12.2020 and issue patta as early as possible.
4. Learned Special Government Pleader appearing on behalf of the respondents has no serious objection for the said order being passed.
5. In view of the aforesaid submissions, this Court without expressing any opinion on the merits of the case directs the 2nd respondent to consider the petitioner's representation dated 15.12.2020 on merits and pass appropriate orders in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
6. This writ petition is accordingly disposed of with the aforesaid direction. No costs.
