( Criminal Jurisdiction ) Wednesday, the Twenty Seventh day of April Two Thousand Twenty Two PRESENT The Hon`ble Dr Justice G. JAYACHANDRAN CRIMINAL ORIGINAL PETITION No.9295 of 2022 AZHUKKU SATHISH @ SATHISH KUMAR [ PETITIONER / ACCUSED ] Vs THE STATE REP BY [ RESPONDENT ] THE SUB INSPECTOR OF POLICE, P1, PULIANTHOPE POLICE STATION, PULIANTHOPE, CHENNAI.

CRIME NO.273/2022.

For Petitioner : M/S. A.NIRMAL KUMAR Advocate For Respondent : M/S.S.SANTHOSH, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner herein, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8 (c), 20(b)(ii)(A) of Narcotic Drugs & Psychotropic Substances Act, 1985 @ 294(b), 341, 324, 385, 307, 336, 427 & 506 (ii) of IPC in Crime No.273 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The petitioner herein, apprehending arrest by the respondent police in a case connected with seizure of 570 grams of ganja from one Vijayan and one Saloman, is before this Court.

3. Though the learned counsel for the petitioner would state that nothing was recovered from this petitioner even in the First Information Report his name is not mentioned. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Crl.side) opposed granting bail on the ground that one of the accused persons is the father of this petitioner and the confession statement of the accused implicates this petitioner as the person, who used to procure ganja from Andhra Pradesh and sell it to the public through the arrested accused, from whom 570 grams of ganja in seven packets kept for retail selling recovered. Further the learned Government Advocate (Crl.side) also states that this petitioner is having 11 previous cases and two cases pertaining to the narcotic drugs and the confession statement of the 1st accused indicates that he is the person, who procures ganja in bulk and distribute to others for retail selling. Since the source of ganja and the modus operandi in distribution and selling has to be probed, custodial interrogation of this petitioner is required.

4. Hence the petition for anticipatory bail is dismissed. -sd/- 27/04/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
