Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the third respondent to remove the encroachment of the common path which is situated at S.No.88/16, Meiyur Village, Thiruvanmalai Taluk, Thiruvanmalai District (which is belong to National Highway) by 6th respondent herein. (Made by the Hon'ble Chief Justice) Heard Ms.B.Bhuvaneshwari, learned counsel for the petitioner and Mr.A.Edwin Prabakar, learned State Government Pleader assisted by Mr.K.Karthik Jegannath, learned Government Advocate for respondent Nos.1 to 3.
2. It is submitted that there is an encroachment on the pathway in the land in S.No.88/16.
3. Learned State Government Pleader submits that survey would be conducted preferably within a period of four months and if any encroachment is found upon survey, then action, in accordance with law, to remove the encroachment would be initiated within a period of one month thereafter.
4. In view of the said statement, the writ petition stands disposed of. There shall be no order as to costs. (S.V.G., CJ.) (J.S.N.P., J.) 29.04.2024 Index :
