PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India for speedy disposal of suit in O.S.No.291 of 2017 pending on the file of District Munsif Court, Chengalpet. For Petitioner : Mr.S.Kumaresan For Respondents : Mr.S.Jaganathan

O R D E R

The Civil Revision Petition is filed for speedy disposal of the suit in O.S.No.291 of 2017 filed by the petitioner in the year 2017. On direction, the petitioner produced 'A' diary extract to the Court.

2. From the perusal of the "A" Diary extract, it is seen that an interlocutory application vide I.A.No.1388 of 2017 in O.S.No.291 of 2017 is pending from 06.10.2017. The above said application is still at the counter stage. The petitioner seeks for early disposal of the suit in O.S.No.291 of 2017. A further perusal of the "A" Diary extract reveals that suits of the year 2003, 2005, 2006, 2008, 2010, 2013 and 2015 are all pending for trial. When the old matters are pending, the claim 2/4

made by the petitioner to take up the suit filed in the year 2017 on out of turn basis is not sustainable. However, the Trial Court is directed to dispose of the interlocutory application in I.A.No.1388 of 2017 in O.S.No.291 of 2017, as expeditiously as possible.

3. The Civil Revision Petition is disposed of with the above observation and direction. No costs.
