Mr.Rajnish Pathiyil, learned Senior Standing Counsel who accepts notice for the respondent contests the writ petition on merits. However, he would have no serious objection to the alternate request of the petitioner for filing of an appeal in light of medical certificate dated 20.03.2023 placed at page 72 of the compilation.

2.Hence, acceding to the request of the petitioner to be permitted to file an appeal albeit a belated one before the first appellate authority, such liberty is granted. Appeal if filed, within a period of one week from today, will be entertained without reference to limitation but ensuring compliance with all other statutory conditions including pre-deposit. 3.This writ petition is dismissed with liberty. No costs.
