ORDER
The petitioner apprehends arrest for the alleged offence under Sections 296(b), 115(2), 329(3), 132, 351(2) of BNS, 2023 in Crime No.444 of 2025, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner trespassed into a school and quarrelled with certain teachers. When the defacto complainant and another teacher intervened to pacify the situation, the petitioner allegedly attacked the defacto complainant and the teachers. Hence, the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. He also submitted that this is the third anticipatory bail petition, and that the earlier petitions were dismissed by this Court in Crl.O.P. Nos. 32440 of 2025 and 2695 of 2026, by orders dated 27.11.2025 and 05.02.2026 respectively. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal Side) reiterated the prosecution case and strongly opposed the bail petition on the ground that the petitioner has six previous cases. Hence, he opposed the grant of anticipatory bail.
5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the materials available on
record.
6. From the submissions made by the learned Government Advocate (Criminal Side), it is seen that the petitioner has six previous cases to his credit, which clearly demonstrate that he does not deserve anticipatory bail, as he has subverted the course of justice whenever he was enlarged on bail. Apart from that, the allegations against the petitioner also appear to be serious in nature, as it is contended that he trespassed into a school and created a ruckus. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly, this Criminal Original Petition is dismissed. 27-03-2026 MPA To
