O R D E R

This writ petition has been filed for the issue of a writ of mandamus directing the 1st and 2nd respondents to conduct enquiry based on the representation made by the petitioner on 20.02.2020, wherein the petitioner has alleged that respondents 4 to 7 had trespassed into the patta land and removed the coconut trees by using JCB with the help of the police and also damaged two acres of maize crops and sugarcane crops and thereby caused a total loss of Rs.5/-lakhs. 2.Heard Mr.K.Thenrajan, learned counsel for the petitioner and Mr.A.Selvendran, learned Special Government Pleader for respondents. 3.In the considered view of this Court, the incident is said to have taken place in the year 2020. A counter affidavit has been filed by the 4th respondent, wherein it has been specifically stated that proceedings were initiated under the Land Encroachment Act and notice was issued under Section 7 of the Act. Thereafter, 2 / 4

consequential notice under Section 6 was also issued and since the petitioner did not remove the encroachments the encroachments, were removed by the official respondents.

4.In the light of the above stand taken, the relief as sought for by the petitioner cannot be granted by this Court.
