ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(a) r/w. (1-A) (ii) of Tamil Nadu Prohibition Act in Crime No.627 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that the respondent police intercepted a car near the Velankudi Check Post, which was coming from Karaikal, and found that it contained rectified spirit. On seeing the police, the accused fled away from the scene of occurrence. Hence, the complaint. 3.The learned counsel for the petitioner would vehemently contend that Section 7 of the Prohibition Act has not been invoked against the petitioner and, therefore, he may be enlarged on bail.

4. However, the learned Government Advocate (Criminal Side) would strongly oppose the bail application on the ground that the petitioner has 35 previous cases to his credit. In such circumstances, it is evident that if bail is granted to the petitioner, he would misuse the same and subvert the course of justice.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. Considering the antecedents and conduct of the petitioner, this Court is of the view that he does not deserve anticipatory bail. Accordingly, this Criminal Original Petition is dismissed.
