ORDER

The petitioner apprehends arrest for the alleged offence under Sections 24

(1) of Cigarette and Other Tobacco Products Act, 2003 and Section 77 of the Juvenile Justice (CIS and Protection of Children) Act, 2015, in Crime No.6 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that, the petitioner was found in illegal possession of 178 kg of banned tobacco products. Hence, the complaint.

3. The learned counsel for the petitioner submitted that this is the third anticipatory bail application. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and that he is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that there is no previous case pending against the petitioner. He further submitted that the quantity of contraband involved in this case is 178.4 kgs worth of Rs.2,74,000/-. Hence, he opposed to grant anticipatory bail to the petitioner.

I have given my anxious consideration to either side submissions. 6.Considering the nature of offence and the fact that the quantity of banned tobacco involved (178.4kg) is substantial, this Court is of the view that, the petitioner does not deserve anticipatory bail. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail.
