DATED: 01-04-2026

CORAM

THE HON'BLE MR.JUSTICE C.KUMARAPPAN M.Vijayakumar S/o.Meghji Manji Patel, No.559, Phase-1, South Avenue Road, Sathuvachari Post, Vellore District.

..Petitioner(s) Vs State rep by, The Inspector of Police, Sathuvachari Police Station, Vellore District.

Crime No.463 of 2024 ..Respondent(s) PRAYER : Criminal Original Petition filed under Section 482 of BNSS, 2023, to enlarge the petitioner on bail in event of his arrest in Crime No.463 of 2024 pending investigation on the file of Respondent Police and thus render justice. For Petitioner(s):

M/s.G.Balamanikandan For Respondent(s):

Mr.P.Dhileepan Government Advocate (Crl.Side)

ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 3(1), 4(1) and 5(1)(a) of Immoral Traffic (Prevention) Act, 1956 in Crime No.463 of 2024, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner joined hands with other accused running a brothel house. Based on information received, the police searched the premises and rescued six victims. Hence,the complaint. 3.The learned counsel appearing for the petitioner submitted that this is the third anticipatory bail petition. He further submitted that he is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail.

4. Per contra, the learned Government Advocate (Criminal Side) would strongly oppose the bail application on the ground that there is one previous case of a similar nature pending against him. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. From the submissions made by the learned Government Advocate (Crl.Side), it is demonstrable that the petitioner is a repeat offender, which clearly makes it clear that as and when the petitioner is enlarged on bail, he misuses the liberty by repeatedly committing offences. Hence, taking into

consideration of the character and conduct of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 01-04-2026 DRL To
