ORDER
This writ petition has been filed for issuance of a Writ of mandamus directing the respondents to process the withdrawal of the Contributory Pension Scheme(CPS) fund for the petitioner's deceased daughter Dr.J.Dhanalakshmi, based on the petitioner's representation dated 04.02.2026.
2. The case of the petitioner is that her daughter was appointed as Assistant Processor in the Department of Oral Pathology at Tamil Nadu Government Medical College & Hospital on 31.07.2014, bearing ID Card No.TNGDC F 00128 and CPS No.7000241214. She was a divorcee and has no children. Unfortunately, she died due to fire accident on 31.01.2025, Thereafter, the petitioner submitted all necessary documents, including the death certificate and legal heir certificate, before the respondents for withdrawal of the CPS amount. Subsequently, On 04.02.2026, the petitioner has submitted a representation seeking withdrawal of the CPS amount. However, no orders have been passed on the said representation till date, which constrained the petitioner to file the present writ petition.
3. Heard the learned counsel appearing on either side and perused the materials available on records.
4. Considering the limited relief sought in this petition, this Court, without expressing any opinion on the merits of the claim, directs the respondents to consider the petitioner's representation dated 04.02.2026, if not already considered, and pass appropriate orders on merits and in accordance with law, within a period of six(6) weeks from the date of receipt of a copy of this order and communicate the same to the petitioner.
