ORDER
This Civil Revision Petition is filed to set aside the order dated 23.02.2023, made in I.A.No.4 of 2021 in O.P.No.3025 of 2020 on the file of the learned IV Additional Principal Family Court, Chennai.
2. When the matter came up for hearing, the learned counsel on record for the petitioner has filed a memo, dated 13.06.2023 and sought for leave of 1/4
this Court to withdraw the petition filed and a copy of the memo is also furnished before this Court.
3. In the memo the petitioner has mentioned that he intends to withdraw the Civil Revision Petition with a liberty to adjudicate the issue in the trial.
4. The learned counsel on record for the respondent has raised objection stating that he cannot reserve his right to agitate this matter again before the Trial Court. It is to be noted that once visitation right decided by the Trial Court in I.A.No.4 of 2021, the petitioner cannot again file another application for seeking similar relief. However, in respect of other rights, if the petitioner feels, he has got right to agitate his right before the Trial Court, he can agitate before the Trial Court, if the law permits. With the above observation, this Civil Revision Petition is disposed of. No costs. 13.06.2023 jai Index:Yes/No Speaking Order: Yes/No 2/4
