Order The petitioner has filed this writ petition to direct the 3rd respondent to consider the petitioner's representation dated 06.08.2025, seeking to construct Limited Use Subway without affecting the 14 feet service road to the petitioner's property.
2. Case of the petitioner is that he is the owner of the larger extent of land situated at Kainoor Village, Arakkonam Taluk, Ranipet District. In the west of his plot, there was an existence of railway level crossing gate. In 2020, Railway Department proposed to close two level crossing gates and also proposed to construct a LUS-Limited Use Subway. Thereby, the 1st respondent also accorded permission for construction of a road under bridge at Vadamambakkam Village and also directed that the railway should lay a service road on western side of the Railway track leading to the flyover connecting Arakkonam-sholinghur Highway.
3. Since the laying of said service road would deny the petitioner's access to the existing plot of him, he sent a representation dated 06.08.2025 to the 2nd respondent. The said official forwarded the same to the 3rd respondent for taking necessary action, however till date the representation has not been considered
and it is kept pending. Hence, the petitioner is constrained to approach this Court by filing this writ petition.
3. The learned counsel appearing for the petitioner would submit that it would suffice, if the third respondent is directed to dispose of the representation of the petitioner dated 06.08.2025 on merits and in accordance with law, within a specified period.
4. The learned counsel appearing for the respondents has no objection for such an order being passed by this Court.
5. Heard the learned counsel appearing for the petitioner and learned counsel appearing for the respondents.
6. In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the third respondent to consider the representation of the petitioner dated 06.08.2025 and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
