The learned Counsel appearing for the petitioner seeks permission of this Court to withdraw this Criminal Original Petition. To that effect, he has made an endorsement in the case bundle.

2. When the matter was taken up for hearing, the learned counsel for the appellant submitted that the respondent had passed away on

M.DHANDAPANI,J.

rli 27.03.2024 thereby sought permission of this Court to withdraw this appeal with liberty to the appellant to file a civil suit before the competent civil Court. An endorsement to the said effect was also made by the learned counsel for the appellant in the appeal today.

3. In view of the submission made by the learned counsel for the petitioner, this petition is dismissed as abated at the SR stage itself and the petitioner is granted liberty to work out his remedy in accordance with law.
